Fast-tracking of delayed migration cases in danger

The Swedish Migration Agency has proposed a "temporary pause" in processing "delay claims" for work permit and citizenship cases, which would prevent individuals from requesting a decision on their case if four or six months have passed.

The Swedish Migration Agency (Migrationsverket) is seeking to temporarily suspend the option for applicants to request that their work permit or citizenship application be fast-tracked if processing is delayed.

According to Migration Agency's director general Mikael Ribbenvik, the current system, introduced in the summer of 2018,  places an undue burden on resources, leading to longer processing times and increased appeals to the courts.

The "delay claim" provision is now under review, with the Migration Agency, requesting a pause to the law for 18 months.

The Ombudsman for Justice has previously criticized the agency's handling of citizenship cases, which has resulted in automatic rejection of delay claims for applications not dealt with in time. Critics of the proposal argue that it could lead to errors and unfair treatment of applicants.

The request is now under review by the Swedish government.
